What a freehold estate director actually has to run
Estate charges, the resident company, and the day-to-day work on a private freehold estate.
In brief
For freehold estate directors
What is a freehold private estate?
A freehold private estate is a housing development — typically new-build houses or a mixed development — where residents own their homes freehold but pay a recurring estate charge to cover the upkeep of communal areas: shared roads, footpaths, lighting, play areas, or landscaping. Unlike a leasehold block, there is no landlord charging service charges under a lease. Instead, the obligation to pay estate charges is written into the title deeds at the time of purchase. A residents' management company (or a developer-appointed management company) collects the charges and manages the estate. Residentive is built for both models: leasehold blocks where residents pay service charges under a lease, and freehold estates where residents pay estate charges under their title deeds.

Key points
The challenges estate directors face
No central ledger
Estate charge income and expenditure sit in a spreadsheet, or in an agent’s year-end pack, so the board cannot see the year as it happens.
Directors’ personal mobiles
Residents call the people they elected. There is no published number, and the same director becomes the helpdesk.
No resident portal
Owners cannot open the accounts or raise a job without emailing the board.
Jobs lost in email
Estate maintenance — roads, lighting, landscaping — is instructed in threads that nobody can search after the director steps down.
Insurance on a spreadsheet
Renewals, commissions, and policy documents are tracked by hand, often with one date per contractor and none for the estate.
Accounts filed late
The company still has to file. A volunteer board with no ledger is how confirmation statements and accounts slip.

The ProperSuite for estates

A live ledger of estate charge income and expenditure, with reports the company can take to its accountant and to Companies House.
ProperPortal™
Residents open their own accounts, documents, and jobs. The board stops being the only copy of the file.
ProperResponse™
Riley™ answers the estate line. Maintenance reports are logged. Only the calls that need a director are escalated.
ProperHub™ and ProperInsurance™
Trades are instructed with a job record, and the buildings or estate policy is held in one place rather than a renewal spreadsheet.
Checklist
Compliance for estate directors
- Directors of the estate company still have Companies Act 2006 duties: accounts, the confirmation statement, registers, and notice of changes to Companies House.
- The estate charge is payable because the transfer or estate rentcharge deed says so. Demand only what that deed allows, and keep the money for the communal areas it names.
- The Leasehold and Freehold Reform Act 2024 includes provisions aimed at people who pay estate charges. What is in force on your estate, and which forum a dispute uses, should be confirmed with a solicitor.
- Section 20 consultation is a leasehold rule for qualifying works charged under a lease. It does not automatically apply to a pure freehold estate charge. If the site also contains flats, ask a solicitor which document governs which charge.
- A house-only estate is often outside the Building Safety Act 2022. A higher-risk block on the same site can still bring Accountable Person and Golden Thread duties for that building.

Frequently asked questions
Everything you need to know about Freehold Estate Management Software UK.
What is a freehold estate management company?
A freehold estate management company collects the estate charge and looks after communal parts of a private housing estate: shared roads, footpaths, lighting, play areas, or landscaping. Residents usually own their houses freehold. The duty to pay is written into the transfer or title deeds at purchase, often as an estate rentcharge, rather than into a lease. The company may be formed by residents, or appointed by the developer and later handed over. It is not an estate agency, and it is not the resident management company that holds the freehold of a block of flats. If you are unsure which company your transfer names, read the title register and confirm the deed with a solicitor.
Do freehold estate directors have legal obligations?
Yes, if you are a director of the company that manages the estate. Companies Act 2006 duties still apply: file accounts and the confirmation statement, keep the registers, and tell Companies House when directors or the registered office change. You also have to demand and spend the estate charge only as the transfer or estate rentcharge deed allows. That money is for the communal areas the deed names. A house-only estate is often outside the Building Safety Act 2022, but a taller block on the same site can still bring Accountable Person and Golden Thread duties. Confirm your personal exposure, and what the company must maintain, with a solicitor.
What is the difference between a service charge and an estate charge?
A service charge is what leaseholders pay under a lease towards the costs of maintaining, repairing, and insuring a block. In England and Wales that sits under the Landlord and Tenant Act 1985, including demand rules updated by the Leasehold and Freehold Reform Act 2024. An estate charge is what freehold owners pay for communal areas on a private estate. The obligation is in the title deeds or an estate rentcharge deed, not in a lease. The work feels similar. The document that makes the charge payable is not. Do not treat an estate-charge demand as a service-charge demand unless a solicitor has told you the same rules apply to your deed.
Can freehold estate residents challenge their estate charges?
They may be able to, but not by assuming the leasehold route applies. A leaseholder can ask the First-tier Tribunal whether a service charge is payable and reasonably incurred. A freehold estate charge is a different obligation. What a resident can dispute depends on the transfer, any estate rentcharge deed, and the estate-charge provisions in the Leasehold and Freehold Reform Act 2024, which were written to strengthen cost protections for people who pay those charges. Those provisions do not turn every estate into a leasehold block, and what is in force still matters. Start with the deed and the latest accounts. Before anyone withholds payment, a solicitor should confirm the forum and the time limit that applies to that estate.
Do I need professional software to manage a small freehold estate?
The law does not name a software product, and a small estate can be run by directors who will do the work. The obligations do not shrink because there are fewer houses. The company still has to demand only what the deed allows, keep accounts Companies House will accept, instruct contractors, and answer the people who pay. Spreadsheets and personal mobiles are how most small estates start, and how jobs, renewals, and the ledger get lost. Residentive is the platform for that seat: a live estate-charge ledger, a resident portal, and 24/7 call handling, whether the board self-manages or appoints a manager. It does not replace the deed or a solicitor.
How is freehold estate management different from block management?
Block management is the running of a leasehold block of flats. Residents pay a service charge under a lease, and qualifying works can trigger Section 20 consultation under the Landlord and Tenant Act 1985. Freehold estate management is the running of a private estate, where owners pay an estate charge written into their title deeds for shared roads, gardens, or facilities. Both have a residents' company, annual accounts, contractors, and insurance. The legal framework differs: the lease and landlord-and-tenant law on one side, the transfer and estate rentcharge on the other. Residentive is built for either, or both on one site. It is not an estate agency. If the site contains flats, ask a solicitor which document governs which charge.
